Key Requirements for Permanent Residency in Poland for a Spouse

These are the four key and basic requirements that you complete when you apply for permanent residency based on your spouse in Poland.

  1. You have completed three years of your marriage.
  2. You have completed a two-year legal residence based on your residency permit that was issued based on marriage to a Polish citizen.
  3. You are staying with your spouse in Poland; this can be proven with your house contract or zameldowanie that you make when you enter a house together.
  4. You are not out of Poland for 10 months in total during these three years. If yes, then it will be an issue for you when you apply for permanent residency.

How do I count my time period for PR?

You can count the day you received your first residence card decision, not just a plastic card, and then go for the next two years based on this card. That means you have to check the issue date on your first decision letter, and then you can count your time from that.

Does the waiting time between temporary residencies count towards PR?

Well, this is a tricky question, and if you need an answer in yes or no, then no, it doesn’t count technically. The count only includes the period where you have a residence permit as part of the waiting time. That means the waiting time from the first card to the second card is not counted toward the two years of residency requirements. This time, of course, is included in your three-year marriage period.

 

Is a language certificate needed for this PR?

No, for spouse-based permanent residency, you don’t need to have a language certificate. You just have to submit the above documents that we already mentioned, but of course, other documents are compulsory, like your standard application with a picture and passport, and the application fee, which is around 640 zloty.
